- Eligibility: This “#SantaMariaStyle Wellness Giveaway” is open to individuals who are legal residents of the 50 United States and the District of Columbia and are the legal age of majority in their state or country of residence prior to the date of entry, have internet access and a valid Instagram account and email account. By participating in the Giveaway, entrants agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to this Contest.
- Sponsorship: The “Sponsor” of this Giveaway is the Santa Maria Valley Chamber of Commerce and Visitor & Convention Bureau, located at 614 S Broadway, Santa Maria, CA 93454. Sponsor will conduct the Giveaway substantially as described in these Official Rules.
- Agreement to Rules: By entering this Giveaway, you consent that you are eligible to participate based on eligibility requirements explained in the Official Rules. You also agree to accept the decisions of the Sponsor as final and binding as it relates to the content of the Giveaway Entry Period.
- Information: By entering the Giveaway, you agree that your information may be used by Sponsor and Instagram in accordance with their respective privacy policies.
- The “#SantaMariaStyle Wellness Giveaway” Entry Period: This Giveaway begins at the time of the Instagram post announcing the Giveaway and ends at 11:59 p.m. PST February 29, 2024. To be eligible for the Giveaway, entries must be received within the specified Entry Period.
- How to Enter: During the Entry Period, eligible persons may enter this Giveaway by following @santamariavalley on Instagram, “liking” the Giveaway post, AND tagging three other Instagram users in the comment of the Giveaway post. One bonus entry can be earned by sharing the Giveaway post to the user’s own story in addition to the completing the previously mentioned entry criteria. Any attempt to enter by any other method is void. All entrant information is subject to the aforementioned privacy policies of Sponsor and Instagram. Entries must be received before the expiration of the Entry Period. The computer of Sponsor’s Instagram account administrator is the official clock for this Contest. Limit one entry per Instagram user. NO PURCHASE IS NECESSARY TO ENTER. YOUR CHANCES OF WINNING DO NOT INCREASE WITH A PURCHASE.
- Prizes: The Winner of the #SantaMariaStyle Wellness Giveaway (the “Winner”) will receive a two-night stay at the Historic Santa Maria Inn, a tasting at Presqu’ile for two, and dinner at Pizzeria Bello Forno for two. One winner will be chosen at random and will be provided instructions on how to redeem the prize package.
- The Winner, upon acceptance of the prize, is solely responsible for all expenses related to the prize, including without limitation any and all local, state, and federal taxes. The Winner shall not transfer assignment of the prize to others nor shall the Winner request the cash equivalent or prize substitution. By accepting the prize, the selected Winner grants permission for the Sponsor to use the Winner’s likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law.
- Odds: The total number of eligible entries received determines the odds of winning.
- Selection and Notification of Winners: One Winner will be selected to win the package by a random drawing under the supervision of the Sponsor. The Sponsor will notify the Winner via Instagram following the end of the contest term. The Sponsor is not responsible for nor shall have any liability for any Winner’s failure to receive notices. Nor shall Sponsor be liable for any Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner 1) fails to claim the prize within eight hours from the time the award notification is sent, or 2) is found ineligible, the prize may be forfeited and an alternate Winner may be selected. Receipt of the prize offered in the “#SantaMariaStyle Wellness Giveaway” Entry by the Winner is upon the condition of compliance with any and all federal, state, and local laws and regulations. IF ANY OF THE WINNERS VIOLATE ANY OF THESE OFFICIAL RULES, EACH WINNER (AT THE SPONSOR’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
- Consent and Release: By participating, entrant consents to Sponsor’s use of entrant’s name, city and state of residence, and/or photographs and/or similar related information for promotional, advertising and other purposes in any and all media now or hereafter known throughout the world in perpetuity by Sponsor, without additional compensation, notification or permission, except where prohibited by law. Among other publicity, the winner’s name or Instagram handle may be announced on Sponsor’s social media outlets. Entrants agree to release and hold harmless Sponsor and their respective parent companies, affiliates, subsidiaries, divisions, suppliers, distributors, retailers, Instagram, and advertising and promotion agencies and all of their respective officers, directors, shareholders, employees, and agents (collectively, “Releasees”) from any claims, actions, injury, liability, loss or damage of any kind resulting from participating in this Contest, the use of or from the acceptance, use or misuse of any prize awarded. This Contest is in no way sponsored, endorsed or administered by Instagram.
- Terms & Conditions: In its sole discretion, the Sponsor reserves the right to modify, suspend, cancel, or terminate the “#SantaMariaStyle Wellness Giveaway” should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Sponsor’s control, impact or corrupt the security, fairness, proper conduct, or administration of the “#SantaMariaStyle Wellness Giveaway”. The Sponsor, in the event of any of the above issues, may determine the Winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Individuals who tamper with or attempt to tamper with the operation or entry process of the Giveaway or website or violates these Terms & Conditions will be disqualified by the Sponsor in its sole discretion. In its sole discretion, the Sponsor has the right to maintain the integrity of the “#SantaMariaStyle Wellness Giveaway”, to void votes for any reason, including, but not limited to: multiple entries from the same user; or the use of bots, macros, scripts, or other technical means for entering. Attempts by any entrant to deliberately damage any website or undermine the legitimate operation of the “#SantaMariaStyle Wellness Giveaway” may be a violation of criminal and civil laws. If any such attempt is made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.
- Limitation of Liability: Your entry into this Giveaway constitutes Your agreement to release and hold harmless the Sponsor and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the Giveaway and/or the 1) Winner accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.
- Disputes: PLEASE READ CAREFULLY. Except where prohibited by law, as a condition of participating in this Contest, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, including eligibility declaration forms, publicity releases and waivers, or any prizes awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorney’s fees; (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of California, USA.
- Winners List: You may obtain a copy of the Winner’s name or a copy of these Official Rules, by sending your request via mail with a stamped, self-addressed envelope to: Santa Maria Valley Chamber of Commerce, located at 614 S. Broadway, Santa Maria, CA 93454, United States. Requests must be postmarked no later than 12 p.m. PST March 1, 2024.
- Instagram-Specific Rules: Per Instagram rules, this Giveaway promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. By entering, entrants confirm that they are 13+ years of age, release Instagram of responsibility and agree to Instagram’s terms of use.
